Terms of Service

Dead Air Music ("Dead Air," "we," "us," "our") is a licensed digital radio service that streams curated rock music from 1981–2010. The app provides a personalized listening experience you shape using three tuning dials — Music, Vibe, and DJ. Content availability may vary and is subject to change without notice.

You must be at least 13 years of age to use the app. By using the app you represent that you meet this requirement. Users under 18 should have parental or guardian consent.

New users receive a 7-day free trial starting from first launch. No payment is required during the trial. At the end of the trial period, continued access requires a paid subscription.

• Subscriptions are available on a monthly or annual basis at the current published rates.
• Subscriptions are billed through the app store platform you use (iOS or Android). All billing, payment processing, refunds, and disputes are governed by that platform's terms and handled directly between you and the platform. We do not process payments directly.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription through your app store account settings.
• We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes. Continued use after a price change takes effect constitutes acceptance of the new price.

Subject to these Terms and an active subscription (or active trial), we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial purposes only.

You agree not to:

• Record, capture, redistribute, or reproduce any audio content streamed through the app
• Share, sell, lend, or transfer your account or subscription to any other person
• Use the app on behalf of any other person or organisation without authorization
• Attempt to reverse engineer, decompile, disassemble, or extract source code from the app
• Use the app in any way that violates applicable law or the rights of any third party
• Circumvent technical measures used to protect the service, its content, or its licensing obligations
• Create multiple accounts to extend the free trial or otherwise abuse promotional access

All music streamed through the app is licensed for streaming only. No content may be downloaded, copied, recorded, or stored outside the app. Your use of the service does not grant you any ownership interest in the music or any other content.

The Dead Air Music name, wordmark, logo, app design, and all original content we create are the exclusive property of Gregory Group LLC. You may not use them without our prior written permission.

Your subscription permits one active stream at a time on one device. Sharing your account credentials or subscription access with other people is prohibited and may result in account suspension without refund.

Dead Air requests access to your device's coarse location (approximate location, not precise GPS) to show nearby concerts and local weather. We do not access your precise GPS coordinates. See our Privacy Policy for full details on how location data is handled.

Dead Air Music operates under the statutory license provisions of 17 U.S.C. § 114 of the US Copyright Act. We are legally required to log and report listening activity to music royalty collection organizations for distribution to artists and rights holders.

We aim to provide reliable, uninterrupted service but cannot guarantee it. Streaming quality varies with your network connection. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any interruption of service.

We may suspend or terminate your access at any time for violation of these Terms, attempted fraud, or abuse of the service. Termination does not entitle you to a refund for any unused portion of a paid billing period — refund requests must be directed to the app store platform through which you subscribed.

You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any content will be available at any specific time.

To the fullest extent permitted by applicable law, Gregory Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the app, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

These Terms are governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Jackson County, Mississippi.

We may update these Terms from time to time. We will notify you of material changes via the app or by email. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.
